Martha's Closet Terms and Conditions

Definitions
The "COMPANY" refers to Marthas Closet.

The "BUYER" refers to the purchaser of goods and services.

Summary

The company only accepts orders subject to the conditions of sale to the exclusion of any condition of the buyer.

Payment

Not withstanding delivery, the risk of the goods and the property in the goods shall not pass to the buyer until the goods are paid for in full prior to dispatch.

Prices

Any overseas orders shall be charged to the buyer at current exchange rates. The company has no control or liability over these rates.

VAT

The company's price list includes UK sales tax (VAT) at the current rate. Overseas customers do not pay UK sales tax (VAT) unless they reside in a European community, E. C. country. I.E. Belgium, France, Germany, Holland, Italy, Spain, Denmark, Sweden, Finland, Austria, Eire, Luxembourg, Portugal, and Greece. EC businesses registered for vat are exempt from paying vat providing they can provide their vat registration number (with country code). Proof of identity will also be required.

Fitness for purpose

The company are in no way liable for the purpose and fitment of goods and services supplied to the buyer. The company has no control over the fitment, suitability and method of their application or use. The company excludes any condition or warranty implied by statue or otherwise as to the fitness of its goods or any other particular whatsoever.

Liability

The companys liability to the buyer shall at no time exceed the price of the goods supplied. The company shall be under no liability for any direct loss and/or expense or any indirect loss and /or expense suffered by the buyer or liability to third parties incurred by the buyer. The company shall be under no liability whatsoever for any loss or damage whether direct or indirect resulting from the supply of goods. The company shall be under no liability whatsoever for the quality and purpose of goods supplied to the buyer or to a third party.

THIS CONTRACT IS SUBJECT TO THE LAW OF ENGLAND AND WALES.

RETURNS

The buyer may return any product within 7 working days of receiving it, for refund. Postage costs are non-refundable unless the item has been inaccurately described by Martha's Closet in error.

We take every care to describe our products honestly & accurately and never knowingly misrepresent any item.

The clothing we sell is second hand and will therefore have been previously worn and show minor signs of wear, unless it's condition is described as 'mint'. We always describe any faults that we can see.
If, by human error, we fail to note any faults prior to receipt of the goods, a full refund including all postage costs incurred will be issued to the customer immediately.

SOLD ITEMS


We update items' 'SOLD' status manually and, on extremely rare occasions, if more than one customer orders an item at around the same time, the system may not be updated in time to show the item as 'SOLD' after the first transaction.
In this instance, the second customer to order the item will be immediately refunded.
